Terms of Service

1. Acceptance of Terms

By downloading, installing, or using AudioBolo ("the Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Application. We reserve the right to modify these Terms at any time, and your continued use of the Application constitutes acceptance of any modifications.

2. Description of Service

AudioBolo is a macOS application that provides AI-powered voice-to-text transcription services. The Application allows users to:

• Record audio and convert it to text using AI transcription
• Execute commands through natural language voice input
• Store and manage transcription history
• Use custom keyboard shortcuts for quick access

3. Account Registration

To use certain features of the Application, you may need to create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4. Acceptable Use

You agree not to use the Application to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit harmful, offensive, or illegal content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Application or servers
• Use automated systems to abuse the service
• Exceed reasonable usage limits or engage in activities that could harm other users' experience

5. Usage Limits

The free tier of AudioBolo includes generous usage limits for transcription services. We reserve the right to:

• Set and modify usage limits at our discretion
• Temporarily or permanently suspend accounts that exceed fair usage
• Introduce paid tiers for additional features or higher limits

6. Intellectual Property

The Application and its original content, features, and functionality are owned by AudioBolo and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you create using the Application, including your transcriptions. By using the Application, you grant us a limited license to process your audio for the purpose of providing the transcription service.

7. Third-Party Services

The Application uses third-party services including OpenAI's Whisper API for transcription. Your use of the Application is also subject to:

• OpenAI's Terms of Use and Usage Policies
• Supabase's Terms of Service

We are not responsible for the practices of third-party service providers.

8. Privacy

Your use of the Application is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Application, you consent to the practices described in the Privacy Policy.

9. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OF TRANSCRIPTIONS

We do not guarantee that the Application will be uninterrupted, secure, or error-free, or that transcriptions will be 100% accurate.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUDIOBOLO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APPLICATION.

11. Indemnification

You agree to indemnify and hold harmless AudioBolo and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Application or violation of these Terms.

12. Termination

We may terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Violation of applicable laws
• Abusive or harmful behavior
• At our sole discretion

Upon termination, your right to use the Application will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AudioBolo operates, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
